Employers hire consultants and advisors to shift their risk and reduce liability and those costs get passed on to participants. Best interests isn’t well-defined so a standard like this just opens people up to lawsuits and the high costs are a way of protecting against those suits. We want advisors to look out for best interests which will vary by client, but a fiduciary standard may not get us there.
